THE Court of Appeals issued a Temporary Restraining Order (TRO) granting the prayer of the Clark Development Corp. (CDC), led by its President and Chief Executive Officer Agnes Devanadera, and the Bases Conversion and Development Authority (BCDA).
To recall, the RTC, Branch 66, Capas, Tarlac previously issued a Writ of Preliminary Injunction enjoining CDC and BCDA from forcefully taking over the Kalangitan Sanitary Landfill. CDC then elevated the case to the Court of Appeals by way of a Petition for Certiorari with prayer for the issuance of a TRO and/or Injunctive Writ.
