IN the recent case of Bohol Wisdom School et al. v. Mabao promulgated on July 23, 2024, the Supreme Court once again declared that pregnancy out of wedlock is not immoral or disgraceful in the eyes of the law and the public.

In this case, Bohol Wisdom School suspended the grade school teacher for becoming pregnant outside of marriage. The teacher was suspended indefinitely without pay due to immorality until she married her boyfriend. The teacher filed a complaint for illegal suspension. The labor arbiter held that she was constructively dismissed, but the National Labor Relations Commission reversed this decision. While the Court of Appeals ruled that there was no constructive dismissal, it found the suspension illegal. The Supreme Court affirmed the Court of Appeals' finding of illegal suspension. It held that sexual relations between two unmarried and consenting adults are not immoral.
