THE Supreme Court has ruled that an employer is liable for the unpaid salary and payment of damages to its employee who has been a victim of sexual harassment in the workplace for failing to prevent the commission, as well as for its failure to provide procedures for the resolution or prosecution of such an act.

In a decision penned by Associate Justice Jhosep Lopez, the high court's Second Division affirmed the May 31, 2019 decision and the Nov. 23, 2020 Resolution of the Court of Appeals (CA) finding that Xerox Business Services Philippines Inc. constructively dismissed an employee in relation to a sexual harassment case.
