THE Supreme Court has ruled that heirs of injured or deceased workers have a choice of remedy to file compensation claim under the Labor Code or proceed to file for damages under the Civil Code.
In an en banc decision penned by Justice Rodil Zalameda, the high court said that a remedy can be availed of by the heirs even as the Labor Code on Employees Compensation and State insurance Fund has already superseded Article 11 of the Civil Code.
