I have been renting a townhouse where I maintain my residence for years. Last year, Juana, the owner, and I renewed our lease contract for another five years. The contract contained a provision that in case Juana sells the subject property, I have the preferential right/ right to first refusal before it is offered to other prospective buyers. Unfortunately, the owner violated this when she sold the leased property without first offering to me. I plan to file a complaint to annul the sale because I am interested in buying the unit. May I maintain an action to annul their contract of sale even if I am not a party to a contract of sale?|
