Dear PAO,

I was constrained to enter into a contract with our neighbor for the purchase of goods amounting to P40,000. I really had no intention of buying anything from him, but he kept intimidating and terrorizing me. This is actually the second time. The first one, the amount of the goods was only P3,000, so I let it slide. But this time around, the amount is so burdensome I do not want to give in to him. Can I have that contract annulled? If yes, is there a period that I should take note of?

Phia

Dear Phia,

As defined under our law, a contract is "a meeting of minds between two persons whereby one binds himself, with respect to the other, to give something or to render some service." (Article 1305, New Civil Code of the Philippines)
