Loss of earning capacity

Dear PAO,

My daughter was killed in a road accident. At the time of her death, she was a high school student with a very bright future. She was smart, diligent and dedicated in all of her endeavors. As such, we demanded from the driver and operator the loss of earning capacity of my daughter. To our dismay, however, they not just dismissed our claim, but also vehemently claimed that my daughter was not entitled to any of that since she was not even earning anything, let alone employed at the time of her death. I want to know if we can claim for her loss of earning capacity in case we pursue a case against the responsible persons who took the life of my daughter.
