There were two lawyers who handled my civil case for damages. I lost the case with my first lawyer before the Regional Trial Court in Quezon City. Consequently, on appeal, I engaged a new lawyer. I advised him to adopt a new theory. To my surprise, however, instead of acceding to my request, he just rehashed the faulty theories and positions of my initial lawyer. With these turn of events, I decided as well to end our engagement. And now, for my personal serenity, I just want to know if it is true that a case theory is not allowed to be changed on appeal?
